bought calves that died do I have any legal recourse

Hi
I bought 3 calves that where suppose to be 250 lbs and weaned and eating two died within 2 weeks and third is at vets may not make it and is going to cost a lot of $ do I have any legal recourse to get my money back calve where not 250lbs more like 150 vet said hardly weaned should have been on bottle

Did you figure out what caused the deaths?
It may be their fault and it may be yours, hard to say not knowing. I would suggest taking a experienced cattle person with you next time. But first figure out why those ones died. You don't need any diseases running around. Just in case.

Recourse?
Not much. Small claims court maybe....depending how and where they were advertised, but 2 weeks after purchase and taking possession is pretty much on you.

you bought em..you own em..see that with dairy all the time....people don't have a clue and then get butthurt cuz they die..i don't know yer background but if ya cant tell 150 from 250 ...legall recourse...seriously....whatever happened after you own is yer problem...live and learn

Welcome to Cattle Today. Sorry to read of the troubles. A couple of questions..... I am assuming that you are fairly new to cattle? If so, did you take someone with you to look at the calves that knows cattle? It seems that the seller just advertised and a buyer that comes should be able to tell what they are looking at. Unfortunately, I think that you don't have any recourse if there was no written guarantee of any kind. Often there are written contracts on cattle, mostly for registered animals, and those guarantees are either stated at time of sale, or posted in a catalogue if buying at a sale of some sort. To just go and buy some calves that someone said are "so and so" is basically a buyer beware situation. They might or might not have been weaned and not very well fed to start with. There are all kinds of sellers around. But if you had them 2 weeks and then lost them, then it can be assumed that they were not getting fed properly and that is not the sellers fault. I am not saying this is the case, but that is how it can be portrayed.
I am sorry that this has happened to you but I don't see where you have get much of a leg to stand on to go back to the seller. Have you contacted him to tell him what happened?

Sorry for your loss. Legal recourse, nope you're out of luck there. Once you've taken possession it's assumed to be an
'as is' sale and care, custody and control is your responsibility. Even IF you had 10 day guarantee 2 weeks is too late.
When buying baby calves a 50 lb bag of 18% textured calf starter on hand helps in transition to their new feed ration.
Often when in doubt a scale can be your best friend.

I always guarantee any stock I sale. If it is a horse or mule they ride them before they buy, then they are guaranteed the same way any cattle, Llamas, dogs, chickens and anything else I sale. They are guaranteed till they cross the cattle guard leaving my place. I make sure the buyer knows that and IF there was any other kind of a guarantee then it would be put in writing and the buyer and me would both have a copy saying what is covered and what is not.
